This course presents the tax considerations, benefits, and drawbacks of the various types of entities with a focus on real estate investments. Included in the presentation is a discussion on the check-the-box classification system and different types of ownership structures, including general and limited partnerships, limited liability entities, real estate investment trusts (REITs), and outright concurrent ownership. This course includes an election available for a married couple that materially participate as sole owners of a jointly owned and operated rental real estate business to be treated as a joint venture instead of a partnership required to file Form 1065. Similarly, this course includes a discussion regarding Rev. Proc. 2002-22, which provides a safe harbor for taxpayers wishing to have their concurrent ownership of rental property not classified as a business entity for tax purposes, thus avoiding the need to file Form 1065.
